Telemedicine Consent
1. Purpose of This Consent
This Telemedicine Consent sets out the terms under which you may access healthcare consultations conducted remotely through the EUDoctor platform.
The purpose of this consent is to ensure that you are fully informed about:
- The remote nature of consultations
- The inherent limitations of telemedicine compared to in-person care
- The separation of responsibilities between EUDoctor and independent healthcare providers
- The conditions under which consultations may or may not be appropriate.
This Telemedicine Consent applies to all consultations facilitated through the Platform and must be accepted before you can access consultation services. The purpose of this consent is to document your acknowledgement of the remote nature and limitations of consultations facilitated through the Platform. This Telemedicine Consent does not replace, limit, or supersede any informed consent obligations that apply to healthcare providers under applicable medical laws or professional standards. Healthcare providers remain solely responsible for obtaining any additional consents required in the context of medical care.
2. Nature of Telemedicine and Remote Consultations
You acknowledge and understand that consultations facilitated through the Platform are conducted remotely using electronic communication technologies, including video, audio, chat, or other digital tools.
You expressly acknowledge and agree that telemedicine:
- Is not equivalent to an in-person medical examination
- May limit a healthcare provider’s ability to fully assess your condition
- Relies primarily on the information you provide and what can reasonably be observed remotely;
- May not be suitable for all medical conditions, symptoms, or situations.
You acknowledge that the absence of physical examination, diagnostic testing, imaging, or direct in-person observation may result in limitations, delays, uncertainty, or reduced accuracy in assessment, diagnosis, or treatment.
You further acknowledge and accept that neither EUDoctor nor healthcare providers can eliminate these inherent limitations of telemedicine and that you assume the risks associated with receiving medical advice through remote consultation.
3. Role of EUDoctor as a Platform Intermediary
You expressly acknowledge and agree that:
- EUDoctor operates solely as a digital intermediary platform that facilitates access to independent, licensed healthcare providers
- EUDoctor does not provide healthcare services, medical advice, diagnoses, treatment, or clinical assessments of any kind
- EUDoctor does not act as a healthcare provider, medical institution, employer, agent, partner, or representative of any healthcare provider
- EUDoctor does not supervise, direct, control, manage, or interfere with clinical decision-making, professional judgment, or standards of care exercised by healthcare providers
EUDoctor’s role is strictly limited to providing technical infrastructure, administrative facilitation, and communication tools that enable users to connect with independent healthcare providers.
For the avoidance of doubt, EUDoctor does not assume responsibility or liability for medical services, clinical decisions, or healthcare outcomes arising from consultations conducted through the Platform.
4. Role, Independence, and Responsibility of Healthcare Providers
You acknowledge and agree that:
- All medical services are provided exclusively by independent, licensed healthcare providers
- Healthcare providers act in their own name and under their own professional, legal, and regulatory responsibility
- Healthcare providers are solely responsible for:
- Determining whether a consultation is appropriate
- Assessing the information you provide
- Exercising independent clinical judgment
- Making diagnoses and treatment recommendations
- Issuing prescriptions, referrals, certificates, or other medical documentation
- Complying with applicable healthcare laws, licensing rules, and professional standards
EUDoctor does not verify, endorse, guarantee, or assume responsibility for the accuracy, quality, suitability, or outcome of any medical advice or service provided.
5. Appropriateness of Telemedicine and Provider Discretion
You acknowledge and agree that the appropriateness of telemedicine for your condition is determined solely by the independent healthcare provider exercising their professional clinical judgment.
You expressly acknowledge and agree that:
- A healthcare provider may, at their sole professional discretion, determine that telemedicine is not appropriate for your condition or circumstances
- A healthcare provider may decline to provide medical advice, treatment, prescriptions, referrals, certificates, or other documentation where such action is clinically, legally, or ethically inappropriate
- A healthcare provider may recommend that you seek in-person medical care, additional examinations, diagnostic testing, or specialist assessment
You acknowledge that the exercise of professional discretion by a healthcare provider, including the decision to decline, limit, or discontinue a consultation, constitutes the provision of a professional medical assessment and does not constitute:
- A failure to provide the consultation service
- A breach of service expectations; or
- Grounds for a refund, reimbursement, or chargeback
- Except where required by applicable mandatory law
EUDoctor does not review, override, or intervene in such clinical decisions and assumes no responsibility for the outcome of provider discretion.
6. Emergency and Urgent Care Exclusion
The Platform is not intended for emergency, urgent, or life-threatening medical situations.
You must not use the Platform if you believe that you are experiencing, or may be experiencing, a medical emergency or a condition that requires immediate physical examination, urgent intervention, or emergency care.
In such circumstances, you must immediately contact local emergency services by dialing 112 or seek appropriate in-person emergency medical care. The Platform must not be used as a substitute for emergency services.
You acknowledge and agree that:
- Telemedicine consultations are inherently limited in their ability to assess and manage emergency or rapidly evolving conditions
- Delays in seeking appropriate emergency care may result in serious harm
You further acknowledge that a healthcare provider may, at any time during a consultation, determine that your condition requires urgent or in-person medical attention. In such cases:
- The healthcare provider may instruct you to seek immediate emergency or in-person medical services
- The consultation may be discontinued or terminated where clinically appropriate
- EUDoctor does not assume responsibility for the coordination, provision, or outcome of emergency or in-person care
Continued use of the Platform in an emergency or urgent situation, or failure to follow emergency instructions provided by a healthcare provider, is at your own risk.
Examples of conditions that may require urgent or emergency medical attention include, but are not limited to, severe chest pain, difficulty breathing, loss of consciousness, uncontrolled bleeding, sudden neurological symptoms, or any condition that you reasonably believe poses an immediate risk to your health or life.
This list is provided for illustrative purposes only and is not exhaustive. The absence of a condition from this list does not mean that it is appropriate for telemedicine consultation.
7. Accuracy and Completeness of Information Provided by You
You acknowledge and agree that healthcare providers rely on the information you provide in order to assess your condition and exercise professional clinical judgment.
You expressly acknowledge and agree that:
- Incomplete, inaccurate, misleading, or outdated information may materially affect the quality, safety, or appropriateness of medical advice or treatment
- You are responsible for providing truthful, accurate, complete, and up-to-date information about your identity, including your full name and date of birth, as well as your symptoms, medical history, current medications, allergies, and any other relevant health-related information
- Failure to provide accurate identifying or health information may result in incorrect assessment, inappropriate advice, or refusal by a healthcare provider to proceed with a consultation
EUDoctor and healthcare providers shall not be responsible or liable for adverse outcomes, clinical errors, delays, or limitations in care that arise as a result of inaccurate, incomplete, misleading, or withheld information provided by you.
8. No Guarantees, Clinical Discretion, and Limitations of Outcomes
You acknowledge and agree that medical consultations facilitated through the Platform involve professional clinical judgment exercised by independent healthcare providers and that medical outcomes cannot be guaranteed.
In particular, you acknowledge and agree that:
- No specific medical outcome, diagnosis, treatment result, improvement, or resolution of symptoms can be guaranteed
- Telemedicine consultations do not guarantee the issuance of prescriptions, referrals, certificates, sick notes, or any specific medical documentation
- Healthcare providers may determine, in their sole professional discretion, that no diagnosis, treatment, prescription, or documentation is clinically or legally appropriate
You further acknowledge that the service provided through the Platform consists of access to a professional medical consultation and clinical assessment, regardless of whether a particular medical outcome or documentation is produced.
The absence of a diagnosis, prescription, referral, certificate, or other specific outcome shall not, by itself, constitute:
- A failure to provide the consultation service; or
- Grounds for a refund, reimbursement, or chargeback
- Except where a refund is expressly required by applicable mandatory law.
9. Confidentiality, Prohibition of Recording, and Unauthorised Disclosure
Consultations conducted through the Platform are confidential and intended solely for private interaction between you and the independent healthcare provider.
You expressly acknowledge and agree that you must not, under any circumstances, record, capture, store, reproduce, transmit, publish, or otherwise distribute any part of a consultation, including but not limited to audio, video, screenshots, photographs, transcripts, screen recordings, or similar content, without the prior explicit written consent of all parties involved.
You acknowledge that unauthorised recording, use, or disclosure of consultation content:
- Constitutes a serious breach of confidentiality and professional secrecy obligations
- May constitute a violation of applicable data protection, privacy, and media laws
- May cause significant harm to healthcare providers, EUDoctor, and third parties
EUDoctor expressly disclaims any responsibility or liability for any content recorded, published, or disseminated by users in violation of this prohibition.
Unauthorised recording or disclosure shall constitute a material breach of this Consent and may result in:
- Immediate suspension or permanent termination of access to the Platform
- Preservation of relevant records and logs
- Cooperation with competent authorities where required by law
- The pursuit of available legal remedies to protect legitimate interests, including injunctive relief where appropriate
You assume full responsibility and legal risk for any unauthorised recording or dissemination of consultation content and acknowledge that EUDoctor does not authorise, endorse, or control such actions.
10. Data Protection and Health Data Processing
You acknowledge that health and consultation data processed in connection with telemedicine constitute special category personal data under applicable data protection laws.
Such data is processed in accordance with:
- The Privacy Policy
- Applicable data protection regulations
- Healthcare confidentiality obligations
Independent, licensed healthcare providers act as independent data controllers for medical data processed during consultations.
11. Voluntary Participation and Right to Withdraw
Your participation in telemedicine consultations facilitated through the Platform is voluntary.
You may choose to discontinue use of the Platform or withdraw your consent to participate in telemedicine services at any time. Withdrawal of consent will result in the loss of access to consultation-related functionality from the time of withdrawal onward.
Withdrawal of consent does not:
- Affect the lawfulness of any processing carried out prior to the withdrawal
- Invalidate or reverse consultations that have already taken place
- Entitle you to a refund, reimbursement, or chargeback for consultations already provided, except where required by applicable mandatory law
You expressly acknowledge and agree that withdrawal of consent does not affect:
- Medical records, consultation notes, prescriptions, or other medical documentation already created by healthcare providers
- Statutory or regulatory retention obligations applicable to medical or financial records
- Completed consultations or charges lawfully incurred prior to withdrawal
For the avoidance of doubt, withdrawal of consent relates solely to future access to telemedicine services and does not retroactively affect past consultations, professional assessments, or financial obligations.
12. Consent Confirmation
By selecting “I agree”, checking the relevant consent box, or otherwise indicating acceptance through the Platform, you expressly confirm and acknowledge that:
- You have read, understood, and accepted this Telemedicine Consent in its entirety
- You understand the remote nature of telemedicine consultations and their inherent limitations
- You understand that EUDoctor operates solely as a digital intermediary platform and does not provide healthcare services
- You understand that healthcare providers are independent professionals who retain sole responsibility for medical decisions, advice, and care
- You voluntarily choose to participate in telemedicine consultations under the conditions described in this Consent
You acknowledge that your acceptance constitutes an explicit, informed, and voluntary consent to participate in telemedicine consultations facilitated through the Platform.
If you do not agree to this Telemedicine Consent, you must not access or use consultation services through the Platform.
